Terms and Conditions

When you purchase land from us, you may pay in full or you may finance the property. We offer financing on every property we sell. You do NOT need to qualify for a loan and we do NOT check your credit. Everyone qualifies to purchase from us. WE DO NOT CHARGE A PRE-PAYMENT PENALTY FOR EARLY PAYOFF.

The buyer shall be required to pay a non-refundable documentation fee of , for each property purchased, to cover the costs of document preparation, deed recording and mailing. If purchasing a California, Nevada or Washington property, state transfer tax will also be charged to buyer. All properties are being sold on a Contract for Deed. Buyers are purchasing without the benefit of escrow or title insurance. Title to each property will be conveyed to buyer only after the entire loan balance has been paid in full.

Parcels are available for sale on a first come, first served basis. You will be required to pay the down payment plus a document/recording fee at the time of purchase in order to secure the property. Then, you may either pay the purchase price in full, or you will pay monthly payments on the loan, based on the loan and financing information of that specific property.

Once we have received your down payment and document fee we will send you a Land Sale Contract. This contract must be returned in a timely manner even when properties are being paid in full. Your purchase may be cancelled at seller’s discretion if contract is not returned. Keep a copy of this contract, it is your proof of sale.

Warranties & Disclaimers:

All sales are considered sold, final and binding upon the buyer with receipt of the down payment.

When a monthly payment is paid, it will first be credited to interest then due, then toward principal. THERE IS NO PREPAYMENT PENALTY FOR PAYING THE LOAN OFF EARLY. A late fee of $25 or 10%, whichever is greater, shall be charged if any payment is more than ten days delinquent. A returned check fee of $25 shall be charged for any check which is returned unpaid. A monthly payment processing fee of $9.00 shall be added to the monthly payment of all financed parcels.

Real property taxes which are due and payable prior to date of purchase shall be paid by seller. If the property is purchased with financing, then the property taxes, processing fee and homeowner's association fees (if any) will be added to and included with the monthly payment. If the property is not being financed, the purchaser shall be responsible for property taxes which become due after the date of final payoff.

If a buyer purchases more than 3 parcels, the 4th and all subsequent parcels must be paid in full. Seller reserves the right to limit the number of purchases made by any single purchaser.

All properties are being sold in "as is" condition. Paying the down payment to reserve the property is a final, binding agreement to purchase. All properties are offered subject to Seller's acceptance of the down payment. The sale of these properties is subject to all existing exploration rights, easements, rights of way, assessments, zoning, land use restrictions, covenants, conditions and restrictions.

AS SELLER, WE GUARANTEE THAT THERE ARE NO LIENS ON THE PROPERTY, AND THAT THE TITLE IS MARKETABLE. By making this guarantee, we agree to provide the buyer with a Warranty Deed upon payment in full (Grant Deed in California and Nevada). If buyer discovers a violation of the above guarantees, and seller is unable to remedy such violation within a reasonable period of time, then buyer's sole remedy shall be limited to cancellation of the sale, and a refund of all refundable monies paid by buyer to seller. These warranties extend only to the purchaser, and do not extend to third parties.

As seller, we do not warrant, and we assume no liability for any of the following:

(A) Encumbrances which are identifiable via a physical inspection of the parcel. (B) Utilities or lack thereof. Contact the City or County building department for information on utilities. (C) Mineral rights or the lack thereof. (D) Location and size of the property. Sizes advertised are approximate. (E) Assessments and/or bonds for utilities or homeowner's association dues/fees. (F) Zoning or building codes. Contact the City or County building department. (G) Access. Seller makes no representation or guarantee regarding physical and/or legal access.

In the event a typographical error exists, the seller may correct the error and proceed with recording or re-recording. The explanations on this website shall be considered a portion of the terms and conditions contained herein.

BUYERS MUST PERSONALLY INSPECT AND INVESTIGATE EVERY PARCEL WHICH THEY PURCHASE. Failure to do so will not be grounds for a cancellation or adjustment of sale. Buyers must rely on their own interpretation of property value, and not rely on any statements made by seller, broker and/or third parties. Look before you buy! Inspect the property, investigate the property and its approved uses. Be an informed buyer! Some parcels were purchased by seller sight-unseen. Buyer will be required to acknowledge that they have personally inspected and investigated each property they purchase.

THE SELLER HAS MADE EVERY EFFORT TO VERIFY THE ACCURACY OF INFORMATION CONTAINED HEREIN. HOWEVER, ERRORS DO OCCUR. ALL INFORMATION CONTAINED HEREIN WAS OBTAINED FROM COUNTY MAPS OR OTHER SOURCES DEEMED RELIABLE, BUT IS NOT GUARANTEED AND MAY BE IN ERROR. SELLER DOES NOT WARRANT THE ACCURACY THEREOF.
